Stoked Surf Bali Terms and Conditions
These Terms & Conditions form a binding agreement between you (“the Client”) and CV Stoked Surf Bali (“the Company”), a registered Indonesian Commanditaire Vennootschap (CV) operating in Bali, Indonesia. By making a booking, you agree to be bound by the following terms and conditions.
1. PAYMENT POLICY
1.1 Payment can be made via our secure international payment provider (WeTravel) through our website, or via an invoice issued by the Company with a secure payment link.1.2 For lessons and tours: Payment in full is required at the time of booking.1.3 For lesson/accommodation or tour/accommodation packages:

A deposit of 25% may be paid to secure the booking, with the balance payable no later than 14 days before the scheduled start date.

If payment is not received in full before the booking date, the balance must be paid upon arrival.1.4 Bookings are not confirmed until payment has been received in cleared funds.1.5 All prices are displayed in Indonesian Rupiah (IDR) as required by Indonesian law. USD prices shown are for reference only. Final payments made via WeTravel will be processed in USD at the exchange rate applied by WeTravel at the time of payment.1.6 Prices may change without notice. Once a deposit is received, the booking price is fixed at the rate confirmed in writing at the time of booking.
2. ALTERATIONS TO BOOKINGS
2.1 Requests for changes (dates, package type, participant names, etc.) must be submitted in writing at least 48 hours before the scheduled start time.2.2 Changes are subject to availability and are not guaranteed.2.3 Any additional costs resulting from changes are payable immediately.
3. TERMINATION OF BOOKING BY THE COMPANY
3.1 The Company reserves the right to terminate a booking without refund if a Client:

Fails to comply with safety instructions or reasonable directions from Company staff;

Engages in behaviour deemed dangerous, disruptive, offensive, or likely to cause damage, injury, or distress;

Is under the influence of alcohol or drugs during participation.3.2 In such cases, the Company’s responsibility ceases immediately, and any additional costs incurred will be the Client’s responsibility.
4. TRANSFER SERVICE
4.1 The driver will wait a maximum of 5 minutes after the scheduled pick-up time before leaving to collect other guests.4.2 Missed transfers are the responsibility of the Client, and no refund will be provided if a lesson is missed.4.3 Transfers may be delayed by traffic, ceremonies, or unforeseen circumstances. In such cases, reasonable efforts will be made to notify the Client.4.4 Complimentary transfers are available only for specific areas (Tuban, Kuta, Legian, Seminyak, Jimbaran). Additional charges apply for other locations.
5. GROUP LESSONS
5.1 Minimum age: 15 years.5.2 Group lessons start promptly; late arrivals will not be extended.5.3 Group lessons are designed for beginners; experienced surfers are advised to book private sessions.
6. CANCELLATION & REFUND POLICY
6.1 All cancellations must be made in writing. Cancellation fees are based on the total booking price:

28+ days before start date: 15% cancellation fee; 85% refunded.

14–27 days before: 50% cancellation fee.

7–13 days before: 75% cancellation fee.
-
Less than 7 days before: 100% cancellation fee (no refund).
6.2 No refunds are given for:

Unused portions of a booking once commenced;

Bad weather or unsuitable surf conditions;
-
Injury or illness during participation;
-
Late arrival or failure to attend.
6.3 If surf conditions are unsafe, lessons may be modified (e.g., land-based training) or rescheduled. No monetary refund will be offered; a credit voucher valid for 12 months will be issued.
6.4 The Company reserves the right to cancel due to Force Majeure (war, natural disaster, strikes, government restrictions, pandemics, etc.). No refunds or compensation will be payable.
7. EQUIPMENT RENTAL
7.1 A US$50 refundable deposit is required for surfboard rentals.7.2 Repairable damage will be charged at cost and deducted from the deposit.7.3 Lost, stolen, or irreparably damaged boards will incur a US$250 replacement fee.
8. PHOTOGRAPHY & MEDIA RELEASE
8.1 The Client grants the Company permission to use photographs and videos taken during participation for marketing, advertising, and promotional purposes, in any media format, worldwide, without further consent or compensation.8.2 Clients who do not wish to be photographed must inform the Company in writing before the start of the activity.
9. LESSON LOCATIONS
9.1 Lesson locations vary by season for safety and surf quality.9.2 From April–November: Kuta/Legian Beach.9.3 From December–March: lessons may be moved to East Coast locations (e.g., Nusa Dua, Sanur) if conditions in Kuta/Legian are unsuitable. Transport will be provided.
10. INSURANCE & LIABILITY
10.1 The Client is responsible for obtaining personal travel insurance covering watersports and emergency medical care.10.2 Participation in surfing and related activities carries inherent risks. By booking, the Client acknowledges and accepts these risks.10.3 To the maximum extent permitted by Indonesian law:

The Company is not liable for personal injury, illness, or death unless caused by proven negligence;

The Company is not responsible for loss or damage to personal property;
-
The Company is not liable for any indirect or consequential loss.
11. COMPLAINTS
11.1 Complaints must be reported to staff immediately so that reasonable steps can be taken to resolve the issue.11.2 If the complaint is not resolved during the activity, it must be submitted in writing within 7 days of the booking end date.
12. GOVERNING LAW & JURISDICTION
12.1 These Terms & Conditions are governed by the laws of the Republic of Indonesia.12.2 Any disputes shall be subject to the exclusive jurisdiction of the courts in Denpasar, Bali, Indonesia.
13. SEVERABILITY
13.1 If any part of these Terms & Conditions is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
14. Waiver
At the time of booking you will be required Tick an “Agree” box to the Waiver with as outlined below:
By ticking the “I Agree” box and completing this booking, I acknowledge and agree to the following:

Risk Acknowledgement – I understand that surfing and related activities involve inherent risks, including but not limited to injury, drowning, collisions, unpredictable ocean conditions, marine life, weather changes, and other hazards. I participate voluntarily and at my own risk.

Liability Release – To the fullest extent permitted by Indonesian law, I release and discharge CV Stoked Surf Bali, its owners, directors, employees, agents, contractors, and affiliates from any and all claims, demands, liabilities, damages, costs, or expenses arising from my participation, including those caused by negligence, except where prohibited by law.

Insurance Responsibility – I understand it is my responsibility to have adequate travel and medical insurance that covers surfing and watersports.

Medical Treatment – I authorise the Company to arrange emergency medical treatment if necessary and agree to be responsible for all related costs.

Personal Property – I accept that the Company is not responsible for loss, theft, or damage to my personal belongings.

Photography & Media – I consent to the Company using photos or videos of me for promotional purposes without further consent or compensation, unless I notify the Company in writing before the activity.

Governing Law – This agreement is governed by the laws of the Republic of Indonesia, with disputes subject to the exclusive jurisdiction of the courts in Denpasar, Bali.
